It is a 2 year old judgement favouring climate sceptics Lindzen and Happer, made at the Court Of appeal at the Hague. The 27 page submission referenced is highlighted in the text below as is reference to “scientifically valid experiments “ proving CO2 is no threat. I had forgotten about this article, which is well worth the 20 minutes needed to read it and the experiments. I wondered if anyone had seen a valid refutation of the judgement or the experiments, or whether this article remains valid and worth quoting, as it packages the arguments together neatly
“ON NOVEMBER 30, 2023, three eminent American climate scientists – Richard Lindzen Professor of Earth, Atmospheric, and Planetary Sciences, Emeritus Professor, Massachusetts Institute of Technology, William Happer, Professor of Physics, Emeritus Princeton University and Steven Koonin, University Professor, New York University – made a submission to the Court of Appeals in The Hague, the Netherlands, to support Shell against an organisation called Milieudefensie which claimed that the oil giant would be breaking the law if it failed to reduce its CO2 emissions by 45 per cent by 2030. The amazing feature of this judgement is that it was made at all. That this has happened is because the judges in The Hague had no choice but to do their job properly and pay attention to the defence argument. This meant that they had to read the submission, which proved beyond reasonable doubt that the defendant was innocent.
It is reasonable to expect that this ground-breaking case result would catch the attention of the mainstream media and given wide exposure. But no, the MSM is entirely captive of the man-made global warming scam. So it never appeared anywhere except in the mostly silenced organisations that reject the scam.
More recently, on January 26 this year an organisation called Climate Change Dispatch published the results of scientifically valid experiments that proved beyond doubt that CO2 cannot cause global warming. But of course it can be found only in online publications. Reports such as these would never be accepted for publication by so-called authoritative journals such as Nature or Scientific American.

All observations and experiments prove that carbon dioxide warming by infrared radiation is a ‘Hoax’ because the result is always ‘Zero’.
The first known experiment to show ‘Zero’ was when Robert Williams Wood used rock salt for an experiment to prove Tyndall wrong. He built a glass house with panes consisting of rock salt which is transparent to visible light as well as infrared light. He did not find any difference in temperature.
The last known experiment to show ‘Zero’ was the Greenhouse-Effect-In-a-Bottle Experiment by Nikolov-Zeller, which shows that John Tyndall’s 1860 experimental error was ‘not’ keeping the thermopile at one bar pressure. This experimental error is the origin of the ‘Hoax’.
The best observation to show ‘Zero’ was the Magellan probe observation of Venus. Venus, with a quarter of a million times more carbon dioxide than the Earth’s atmosphere, provides the best answer to the problem, by showing that carbon dioxide produces ‘zero’ warming above the lapse rate. The carbon dioxide atmosphere of Venus is at one bar pressure at an altitude of 30.75 miles. The temperature on Venus at that altitude is 1.176 times the Earth’s average surface temperature. The radiating temperature of Venus is 1.176 times that of the Earth, proving that input from the Sun and a change to thermal inertia due to pressure as a precise function of altitude are all that is needed to calculate the atmospheric greenhouse effect.
NASA data from the Magellan probe shows that infrared radiative warming by carbon dioxide is ‘Zero’ and therefore can be scientifically defined as a fraudulent ‘hoax’. The worlds top living expert on the subject, retired MIT Professor of Atmospheric Physics, Dr. Richard Lindzen, said that “Man-made Climate Change” is a quasi-religious movement predicated on an absurd scientific narrative.

You need to state your frames of reference when you quote Venus at “1.176 times the Earth’s average surface temperature.” Are your temperatures in Celsius, Fahrenheit or Absolute? It matters because 1.176 is the number for only one of these. There is a case for Absolute scale, with its zero at about -273.16 degrees Celsius. When comparing Venus to Earth, it is invalid to invoke Celsius whose zero is the “artificial” freezing point of water, which should not enter the argument.

Kelvin. The average temperature on Venus at 30.75 miles altitude is 339 Kelvin and 1.176 times the Earth’s average surface temperature of 288 Kelvin. The Standard Planetary Gray Body (SPGB) radiating temperature of Venus is 181 Kelvin and 1.176 times that of the Earth at 154 Kelvin, proving that input from the Sun and a change to thermal inertia due to pressure as a precise function of altitude are all that is needed to calculate the atmospheric greenhouse effect.

I noted yesterday that MS Copilot now recognises the ocean surface temperature limit of 30C. I got that confirmed by asking the question-

Vicki got a similar response using Grok.
So the surface temperature limiting is now widely recognised. That invalidates all climates models because they inevitably show tropical ocean surface temperature increasing.
The CO2 radiation impact of Happer et el is inconsequential. It might have relevance to a court ruling but it still has no merit from the perspective of real physics.
This year, the regulating process will reject 52.8ZJ. That is solar EMR that will not even enter Earth’s atmosphere due to the reflective power of high altitude atmospheric ice.

The paper arrives at an answer of 0.36W/m^2 for the 37ppm increase over the period observed. When you look at the detail you see that all daytime data had to be removed because it was dominated by reflected EMR. Only 11% of the nighttime data was sufficiently clear to extract the CO2 signal. So after discarding 94.6% of the available data, the author arrived at a figure for CO2 absorption.
But the CO2 absorption does not mean that it can alter the temperature because there are much more powerful temperature regulating processes at play. And these are widely known; just ask Copilot or Grok.
Anyone who produces a surface temperature influence of CO2 more than 0.00#C is still in need of a clue.

There have been Australian Courts hearing about an alleged rape on a Federal Government minister’s desk after hours. One Judge, early in the story opined that there were only two people who knew if a rape took place or not – obviously the two people who chose to Tango – or not to.
Later in the legal proceedings, another Judge found that, “on the balance of probabilities” a rape had indeed occured. Severe penalties followed.
This finding not only amazed me, it frightened me. How can a person decide a fact when the only 2 people who knew of it speak the opposite, one saying there was a rape, the other saying there was not? In essence, one witness is “making stuff up” in modern terminology. So the Judge acting on the balance is actually casting his/her personal wisdom with a roughly 50:50 of agreeing with made up stuff.
If this type of procedure is allowed to continue, all of us should be afraid because we have no protection against a synthetic fit up.
My plea is to be careful about findings made “beyond reasonable doubt” be they in law or in science. Geoff S

The Hague is a bit different to a local court dealing with a rape case, its about the science.
‘The empirical proof that an elephant weighs more than a mouse is observation. The scientific proof is to put both on a scale and weigh them. All agree that from 1950 to 1985, our atmosphere cooled very slightly. It did the same from 1997 to 2015.
‘During both periods, carbon dioxide (CO2) levels rose dramatically.
‘That is empirical proof that CO2 does not cause warming. It is fifty-five years of proof. It is the elephant in the room.’ (Climate Despatch)

All agree that the World warmed up between 1898 and 1940 (roughly) while CO2 rose slightly.
It cooled slightly in the between 1942 and 1979. (It may well have cooled between 1946/7 (very cold winter in UK,Europe) and 1962 (even worse winter in UK, Europe) despite some scientific types claiming that the Arctic would soon be ice free (early carbon dioxide delusions) with the CO2 level rising more.
The first International Conference on Global Warming was held in 1983 (from memory) and by 1988 the hysteria was in full swing. Glaciers and any ice left (in the Arctic) would soon melt causing many island nations would soon be under water (e.g. The Seychelles). By 1989 hysteria took over with claims about “children in England not knowing what snow was” etc. And, as far as I know, holiday seekers haven’t abandoned the too heated Mediterranean for summer in Blackpool. This despite CO2 rising faster. It has reached the level previously seen in the Eemian times – which curiously humans managed to survive).

There is no pronouncement of innocent. Defendants don’t prove their innocence. In criminal cases the decision is either guilty or not guilty. Never innocent. It’s a ruling on the prosecutions case. Not a ruling on the defendant’s innocence.
But anyway, this was a civil case. Beyond reasonable doubt is not typically the civil threshold. It was about whether Shell had an obligation to reduce emissions by 45%. Not just their own, but also that of the users of their product. (Scope 3 mentioned by the court relates to emissions by others using their product)
After Shell lost the initial case, they appealed. Their appeal was successful. But it was not a victory as described in the summary posted at #1.
As a very high level summary. (My interpretation)
The appeals court did not find factual errors in the first decision in relation to climate change.
The reason the decision was overturned was because Shell had on the record its stated aims to reduce its emissions. That it has not yet achieved its own targets yet, and still had time to do so, was not a breach of human rights.
Also, The appeals court determined it was unreasonable for the district court to have imposed a 45% target by 2030 given that targets vary in different jurisdictions.
It seems that the appeals court is of the opinion, or at least didn’t disagree with the district court, that CO2 is the main greenhouse gas. That human caused greenhouse gas emissions are a problem. That climate change is our greatest threat.
Before the red thumbs come. 😆 I’m not stating my opinion. I’m saying what the judgements appear to say.
The decision is by no means a good outcome for those who disagree with the notion of AGW, or disagree CO2 is causing warming.

Readers here will know of my concerns at the advance of digitisation and AI systems which have the ability to upend the world we have known, of which smartphones and our computers are the most obvious manifestation of the problems that could be caused by hacking or theft of identity.
However all this is now threatened on a much wider scale as we increasingly believe we must push ever further and faster to complete digitisation and interlinking of our systems, and the abandonment of analogue solutions which could put a brake on excesses What a very complicated world we have created over the last 15 years or so, which has had a highly detrimental effect on our abilities to interact personally with each other, our freedoms and seems to have done little to improve our happiness and prosperity.

I remember a time when I wanting to know something and had to go to a large library and sort through hundreds of small cards to find a reference. I’d write that down and give it to a person via an opening into a room(s) with a vast number of books and accumulated magazines. Minutes later I would have the book in-hand that might, or might not, have the information I was seeking. If not — back to the card catalog. Fun times!
Now “my livelihood” doesn’t depend on learning things but I do enjoy it and haven’t been rooting around in a card catalogue for about 20 years.

Yes, on an individual basis, it is an amazing tool. Like you and undoubtedly many others on this site, I am an information junkie. So, AI s obviously n amazing tool. I am very aware of its dangers. AI instruments like Grok are programmed to learn and interact with users. Sometimes that is very amusing but I understand the mechanism involved. But the utility of AI even on a domestic basis is astonishing. We are on a farm and technicians are at a distance and difficult to engage. In the last couple of weeks AI assistance has enabled us to rectify a TV problem and a security camera problem without costly outside help. I have also had amazing veterinary advice for cattle when the vet is one hour away.

I enjoy using AI to help plan holidays …..I type in where, when, how and what and it spits out in less than a minute an itinerary …I can refine it, it’ll will give approximate costs, suggest hotels, travel companies, day tours etc etc…..excellent start to the planning….

Both Copilot and Grok already know that ocean surface temperature cannot sustain more than 30C. I spent a couple of years trying to convince their CSIRO of this fact but they were collectively too thick to understand it.
The fact that an electrical engineer is responsible for Grok gives it potential to apply physics and observation to human understanding of the universe rather than fairy tales.

He will no doubt sell you a house, but he may not show you all the options you could find without him.
You might be looking for the information AI does not show you, but its easier to believe that what you are given is the best of all information.

I enjoy reading your articles. I do hope that you have not relaxed the quality control of your input data. If I can argue with extremes, it is potentially efficient to ask AI if the quality control for a piece of research is adequate, rather than personally checking quality piece by piece as hitherto.
I have in mind some recent revelations that nearly all university students now use AI to compose answers to written exams. Further, the examiners know this – some examiners even admit that they use AI to write the exam questions. Now, it is often said that Science advances by the questioning of current wisdom and its replacement by improved versions. We appear to have a problem if AI is to replace this process of advancement. Who is going to have the future skill to create advancement material if their education was skipped in favour of potted AI? How can AI advance its current wisdom when people are not updating it because of a circular loop that feeds on the AI library to update the AI library? Geoff S

I am talking about finding simple well known but hard to find facts. I cannot imagine using AI to find out if the “quality control for a piece of research is adequate”. I am sure experts would differ on the answer so there is no unique answer. Much of the criticism of AI chatbots comes from people expecting them to do what cannot be done.

When talking about ‘better information’, you may not know if that is factual or reliable. Are you then reduced to asking one AI to check the facts of another AI? Sounds a bit like asking Greta Thunberg to check Chris Bowen’s utterances.

I have been to Herculaneum, and yes, although it is a smaller site, there are amazing houses where their stores are still in a state of preservation.Pompeii, of course, is a large town with the full array of facilities preserved. But both are worth a couple of days of exploration. BTW a visit to Vesuvius is worthwhile if it is still allowed. Have a wonderful trip!

We can but hope that you use your deep experience with nuclear technology to canvass actively against the inexperienced, ignorant drivel that anti-nuclear people have been feeding into the population for decades now. For reasons that I cannot understand, they have been allowed to spread dangerous propaganda into schools, some of it apparently labelled as endorsed by government authorities who should be questioning it then banning it.
For too long now, we have been told that “green” solutions to environmental concerns are the only credible ones. This is as stupid as “vegans” claiming that only “vegan” diets are acceptable for daily food intake.
Disclosure: I am a scientist who has worked with the nuclear fuel cycle, for example with the discovery and development of the globally important Ranger uranium deposits.

Some year ago a Geologist friend was ‘doing time’ at a Government Department as a consultant. He wasn’t that keen only getting out of his house a few days a week.
The entire Department was in turmoir because in their warehouse miles away near the port (which dealt with yellow cake exports and someone had found a plastic bag of “URANIUM” which no-one was allowed to(or to scared) to touch. It had been sitting on one of the shelves and every body was afraid to touch it and no ways of moving it were considered suitable.
Eventually he was down at the warehouse and asked the local supervisor (who didn’t now what the fuss was about) who pointed it out. The geologist asked if one of the (about 40) drums of yellowcake about to be loaded next day had a “loose lid”.
The local bloke (who had seen thousands of drums passing through) took a spanner out and said the nearest drum had a loose lid which his spanner could feel. My mate picked up the bag and dropped it into the drum, and said you might have to tighten that lid “just in case”.
Nothing was ever heard about this scary hazard ever again.

A school in Perth asked me about giving lessons on radioactivity. I told them I would send a teaching aid, a plastic strip like a paddle pop used with a tiny amount of gamma radiation baked to to show how a Geiger counter works. The packaging included the word radioactive and it had the usual symbol and the dose.
A few hours after I posted it, I had a frantic call from a post office. “We have cleared the building and now want to know which authorities to contact to dispose of the danger.”
Therefore, to the ignorant, meddling green activists who peddle misinformation about radioactivity, I send a sarcastic “Thank you. Thank you for deliberate, malicious spreading of known misinformation about radioactivity. If you get a thrill from harming the population, think again before you play with fire”. Sheesh! Geoff S

The ban on nuclear power stations was legislated years after the first nuclear power station project was cancelled after it had started construction phase at Jervis Bay NSW near Nowra on Commonwealth Land. The decision was part economics and part discoveries of an abundance of coal and gas natural resources, the government of that period decided to stick to the coal fired power stations, Snowy Mountains Hydro Electric Scheme Project under construction, and approved and opened in 1958 the first nuclear reactor for producing radio isotopes (nuclear medicine and commercial applications) and research purposes. The now ANSTO – Australian Nuclear Science Technology Organisation was AAAEC – Australian Atomic Energy Commission.
Back when Australia’s atomic destiny was decided in the form of a Commonwealth ban on power production, nuclear was considered a dirty word.
It was 1998 and then prime minister John Howard was wedged into a deal with the Greens and Democrats in order to build a new nuclear facility in Sydney, the site of Australia’s only reactor since 1958 which is used for medical applications such as radiation treatments and x-rays.
In order to get a new reactor at Lucas Heights, 40km south of the CBD, Mr Howard agreed to a last-minute amendment to the National Radiation and Nuclear Safety Act after a debate that lasted less than half an hour and introduced legislation banning any more nuclear facilities from being built in Australia.

In the early 1970s after we discovered world class uranium at Ranger One, we frequently took advice from the Australian Atomic Energy Commission at Lucas Heights because we had to come up to steam on radioactivity, particularly safety aspects. They were staffed by highly qualified people. One had a D.Sc. which was rare back then.
There was demonization of ‘nuclear’ in Australia by 1970. Much of it was imported from countries with nuclear electricity, like Great Britain, Germany and USA. A pinnacle of stupidity was reached by Jane Fonda in the movie “The China Syndrome’ released in 1979.
One can understand public fear of nuclear bombs, so it was a piece of cake for the sad anti-anything mob to go anti-nuclear against peaceful uses like electricity generation.
The anti- movement has succeeded because it has not been called out and opposed by enough responsible people like you and Jo and me and other readers here. The mass media was and is particularly to blame by treating these economic terrorists as cute friendly harmless folk instead of recording what was wrong with their messaging and refusing to print their misinformation. ‘Christian Nationalism’ is a nonexistent bugbear created by the press to keep their viewers terrified of their fellow Americans.
Americans are slightly more religious than Europeans or other members of the European diaspora, but zealous bible thumpers who live, eat and breathe their religion are few and far between. Catholicism is the largest denomination, but only because the Protestants are split into so many different denominations and don’t particularly get along. And even American Catholicism has it’s various cliques. Some follow a more muscular Catholicism (this is partiularly true among immigrants, both legal and illegal), while others lean towards a more secular Catholicism that pretty much ignores doctrine other than Jesus being a super-nice guy who loves everyone. There are some on the nuttier end of the Evangelical Protestant wing of American denominations who might believe in something vaguely similar to the ‘Christian Nationalism’ that is supposed to terrify us all, but they a few voices among many and a tiny minority among American believers. The idea their is some monolithic Christian Nationalist movement is patently ridiculous. It’s scare-mongering at it’s finest.

The most expensive feature of new LDVs is what is missing. The corrosion protection.
A couple of owners have had full refund after complaining of serious rust issues after a few months. And ACCC now has LDV in court for making clearly incorrect claims about durability. A vehicle that is structurally compromised due to rust in a couple of years should not be given a durable tag.

A motorist opened their door into a mate’s near-new Pajero with disaster to her car, the car parked in front that hers was pushed into, and the Pajero’s front left guard/bumper/headlight/bonnet and door.
It limped home 250km because there is a sensor in that guard that took a hiding. Insurance are talking about writing it off.

My current motor vehicle was purchased new in 2017 and has Euro-5 diesel compliance and particulate filter, I had installed a second diesel fuel filter and have since new used a commercial supplier on line purchases only additive that cleans the particulate filter and other diesel engine components, also good for dirty engines cleaning. I also use their injector cleaner additive. The exhaust is clean, no soot or moisture, just a slight grey matter on finger if rubbed inside the tailpipe. There is no smoke under power. Last book service 190,000kms which is well under my previous 4 years and 200,000 kms diesel before trading in and engine in excellent condition, same additives.
I considered changing over to a current same model diesel SUV 4WD last year but decided as mine looks like new (washed regularly and ceramic coating applied as a rinse on process) it has never been polished but paintwork shines brightly. No children or dog so interior well above average condition.
The considerations included what the link explains about longer term maintenance and repairs.
After 80,000 kms of country travel including WA and NT before pandemic travelling less since the original shock absorbers were replaced wth Heavy Duty US brand (forget brand name) and at 190,000 kms and shock absorbers still legal and not close to replacement essential I decided to upgrade the front and rear suspension with a heavier duty but standard height system including front struts and shock absorbers and rear coil springs and shock absorbers. I now plan to achieve 500,000 kms and save myself money and what others with later model vehicles complain about like lane monitoring.

Our last Toyota Landcruiser (the 40th Anniversary model) had travelled over 500,000km when we decided to trade the old girl in for the new model.
