        By doing nothing (tacit endorsement perhaps) he encouraged all the perps to go and commit their crimes.

        As we saw in the TX vs. PA et. al. it is very hard to convict on intent, but much easier to do so when the crime has been committed with evidence.

        The election can still be addressed as discussed in the vid and by the time it ends up on floor I expect the populace will be baying for blood.

        Many perps may soon be running for the door (if they are not already) to avoid the rope swing as the swamp is drained and the evil dummocrats, their commie enablers and overlords are removed from the face of the earth.

      Friday night, the Supreme Court rejected Texas’s case against the disputed states for “lack of standing.” There are a lot of theories for this decision, but Dick Morris said the unsayable: The Supreme Court was intimidated by the Democrats’ promised court-packing scheme.

      That facile statement is an insult to Trump supporters. “Standing” is not a complicated concept. In Whitmore v. Arkansas (1990) 495 U.S. 149, 155, the Supreme Court explained,

Congress officially counts the votes in a joint session held in the House chamber on January 6, 2021, with Mr. Pence presiding. The Trump legal team had six weeks to develop a persuasive case. Not much time. They could not even convince Republican judges. It’s over. We’re stuck with Biden. And almost nothing has been accomplished to change Georgia election practices in one month, which could be the second round of bad news. Unlike a movie, sometimes the good guy loses.

        The incumbent Vice President presides over the Joint Session of Congress convened on 6 January to tally the votes from the Electoral College (14 December).

        If the two houses need to split in order to vote separately on one or more objections, then Mike Pence does not preside over the House of Reps.

    They haven’t at this point reached the point where some claim when tyranny becomes law rebellion becomes a duty. That will happen only if Trump fails to use his last option of the Insurrection Act et al to instigate martial law, take over the MSM and social media sites, conduct trials of the traitors and conduct fresh new elections down the road. We have until Jan 20 to see if Trump pulls the trigger. If he doesn’t then the Constitutional Republic is no longer, and all hell will break loose. He is obliged under the Constitution to take all necessary measure to stop Biden from being inaugurated on Jan 20 after having such a fraudulent election. We shall see if he honours that obligation under the Constitution or not.

        Since the Democrats have a majority in the House, the GOP can propose an “alternative slate” of Electors, however it goes nowhere on 6 January.

        If the House rejects an objection (or a motion to replace the certified Electors with the GOP alternative) then even if the Senate supports it, it is decided by the slate certified by the governor (tie-breaker).

        The governors in the six swing states that matter have irreversibly certified the Biden slates, and they will be the ones counted, unless something extraordinary occurs.

        But it won’t even get to that – all states except WI met the “safe harbor” date (8 December), meaning Congress must accept that set of electoral votes – they have no discretion.

        The “safe harbor” protection works as an incentive to the states to ensure they resolve all their disputes, recounts, and challenges in a timely manner. It works to do that.

        And the Electoral College has convened and voted … if the Trump Team had / has strong evidence of fraud, they should have produced it by now. They didn’t help themselves with a breathtakingly incompetent legal team.

    It will be interesting to see of the claim by some that a “safe harbor” provision of the Electoral Count Act dictates changing the slate of electors after election day is a violation of federal law. If that’s the case then Biden will end up being POTUS unless Trump uses his last option under the Constitution. It’s then not even a matter of proving the election was a fraud or not. That would be nice but it takes too long. The real issue is there is so much smoke and mirrors surrounding the election process it causes enough doubt to call into question whether the election is valid or not. In that case they might as well flip a coin. So, a new election has to be conducted using the correct means such that any attempt of commit fraud on any scale is exposed easily and quickly, not months down the track. The only way to conduct a new election is for Trump to do a reset via the Insurrection Act and call in the military who will monitor the progress of the new election. That’s the only way Trump will ever be able to clean up this mess. Otherwise, he might as well throw in the towel on Jan 20 and kiss goodbye to the Constitutional Federal Republic of the US, then watch it crash and burn from afar.

      It goes on to say that President Trump strengthened the Executive Order.

      So, it appears President Obama signed an executive order 14 days before President Trump’s inauguration. Was President Elect Trump informed of the executive order at the time of development and signature.

    If the unthinkable happens and Biden “wins” the election he will soon be removed under the 25th Amendment (medical incompetence to do the job) or will simply resign because be is so demented he will sign any piece of paper his controllers put in front of him (whilst he retains the ability to even hold a pen).

    As evil as Biden is, Harris, who is the intended President, is far worse than Biden. It would be preferable to have Biden over Harris. Although, the reality is that even if he stays as President she will be telling him what to do. At least a Biden figurehead will be better than Harris.

      It might be true but it’s not relevant really … there is a lot of legislation in place – including how the Congress must conduct these election proceedings – that must be observed and adhered to just as much as the Constitution.

      Congress can’t change the way it operates without changing the relevant laws, and the Democrats have a House majority.

      Stephen Miller might well have other things on the backburner, but changing the electoral slates over to the GOP alternatives in those swing states can’t work now – it’s too late – and has been since 8 December in effect.

    The problem with the US election challenge is not that a vast majority of the legal arguments lack merit. The problem is that most of the judiciary are so morally corrupt that they are willing to allow willful, substantial, obvious and ultimately election-swinging violations of the law to happen without consequence.

    The US judiciary have essentially declared that vote fraud will go unpunished and therefore there’s no possibility of ever having an honest election again.

    If Trump doesn’t win this, the Left will take over and it will be the end of the United States as we know it as a Constitutional Republic with representative democracy and it will become a Leftist banana republic like all the others and as Canada will soon become under Trudeau.

      I’ll disagree to an extent. While the Constitution says that “state legislatures” must determine the manner in which electors are chosen, all states have passed laws saying that the party winning the popular vote will be allocated the electoral votes.

      It is also a requirement that any move to change the manner in which electors are chosen must be in place before Election Day – it is obvious that any loophole to allow modification after the votes are counted couldn’t be permitted, and it isn’t.

      And don’t forget the “safe harbor” rules either.

      There is a very strong Constitutional theory that the power to open and count the votes of the presidential electors is vested exclusively in the President of the Senate. The President of the Senate is actually the Vice President of the United States – Trump’s running mate, Mike Pence.

      Therefore, if this theory is true, Mike Pence can simply open the Republican certificates and toss the Democrat certificates into the trash. The Democrats could howl and shout and gnash their teeth, but they cannot count votes that Pence doesn’t open.

      Unfortunately for the writer in the link, this is not true. The role of the incumbent Vice President is largely ceremonial and impartial. As it was designed to be – after all the VP might have very serious skin in the game.

      Four tellers are appointed (two from the House, two from the Senate, and both parties) and the count and total the electoral votes from every state – taken alphabetically.

      If there is a written objection to the electoral votes for a state (in writing, signed by at least one Rep and one Senator), then the two houses leave the Joint Session, in order to briefly discuss and vote on the objection.

      There is no discussion or argument allowed in the Joint Session itself, so the incumbent VP is presiding over a largely powerless session. As it was designed to be.

      Having Mike Pence open the envelopes does not give Donald Trump any advantage on 6 January.

    The Wisconsin Supreme Court ruled today that Governor Tony Evers and other state and municipal officers did not have the legal authority to expand the definition of “indefinitely confined” citizens to permit absentee voting without showing a state ID.

    The ruling appears to open the door for the Trump campaign to challenge any absentee ballot cast in Wisconsin that was outside the legally defined rules to receive them. This judicial decision was reached at the same time Wisconsin legislators voted to affirm their electors. The sad irony is thick.

    On Stephen Miller’s main point in the Fox & Friends interview above, the three sets of “alternative electors” the Republicans named on 14 Dec will not assist Trump’s cause.

    In order for these “alternative electors” in the three swing states that Trump requires to be accepted instead of the certified electors, it would require a simple majority in both houses, voting separately.

    Clearly the Democrat-controlled House will not vote that way, and it is highly unlikely that the Republican-controlled Senate would support the “maverick” electoral votes either.

    But if the Senate did accept the “alternative electors” then Trump still loses, because the tie-breaker is the slate certified by each state governor – and they are all the Biden voters.

    Trump it seems has run out of political pathways – and also probably judicial ones as well, at this stage. Stephen Miller obviously knows all this, so what else could be cooking?

      The Electoral Count Act, often described by academics as “unintelligible,” seems to favor the slate of electors certified by the state’s governor, according to Ned Foley, a professor at Ohio State University Moritz College of Law.

      Also the ultimate tie-breaker is the Supreme Court:

      Academics have sketched out several scenarios. Under one, Pence as president of the Senate could throw out both sets of a state’s electors. Another contemplates that the House of Representatives would end up choosing between Biden and Trump. There is even a scenario in which the Speaker of the House, currently Democrat Nancy Pelosi, could become acting president.

      The Supreme Court may be called upon to interpret the Electoral College Act to break any deadlock.

        The relevant Act is convoluted, however any state that met the “safe harbor” date is deemed confirmed, and even if the Senate ignored that rule, the next step is – which one was certified by the state governor?

        I don’t think anyone is suggesting the Supreme Court would step in and retrospectively over-ride the “safe harbor” provisions, and the finalised certification by the relevant state governor. We’ll see!

      It all comes down to what Trump knows and what evidence he has to support his next move, which is the Insurrection Act et al. If he’s just bluffing then there’s nothing he really can do unless he still goes down that path and risks loosing support even from his own people if it turns out his stories about electoral interference from foreign powers were mostly fake. We know election fraud did take but we simply do not know the extent. It’s a mess that’s fore sure. Presumably Trump knows a lot more than he’s letting out at this stage. We just have to wait and see what he does. The ball is in his court, not the SCOTUS as most people think. That’s the way the Constitutional Law works as the US is a Constitutional Federal Republic with the POTUS as the supreme head of state. He just has to abide by the Constitutional Law and be able to back up his reasons. If he can’t then he should just walk away. If he can then he will push the reset button. Time will tell which way it goes.

        We do not need to prove the extent od fraudes.
        If it is possible to conclusively show electoral procedures were avoided, or prevented from being applied, or altered, etc……even in just one location,….then that demonstrated that the entire vote could be suspect and requires a extensive investigation…as a minimum.
        There is plenty of video and avidavit evidence to meet that requirement……
        ..it just needs a honest judiciary system to hear it !

          I agree that the honesty (let alone competence) of various judiciaries cannot be taken for granted.

          However the system (to the extent that it is robust and coherent) requires actions to occur within pretty strict guidelines.

          There have been several key dates that are now passed – and they do matter:

          3 November: any changes to the manner in which states choose electors had to be in place before Election Day

          8 December: any slate of Electors that has “safe harbor” status (including a certificate from that state saying the election was fair) has absolute precedence over any other slate that does not have “safe harbor” status – that is the law

          And coming up:

          6 January: all the slates (and it is 49 plus DC) that met the “safe harbor” deadline must be considered conclusive, and objections to them cannot be entertained

          Now if it is the case that over the three weeks between now and 6 January all sorts of evidence is produced saying that the vote in various key states was not kosher – then in terms of the relevant legislation, it might well be all too late. We’ll see.

          But realistically, the Republican effort to create “alternative electors” in 6-8 states might not amount to much – since they do not have (a) compliance with the popular vote winner, (b) safe harbor status, or (c) governor certification.

          Such efforts are starting from an awful long way behind. Even credible evidence of fraud or law breaches might well be far too late.

            Yes, that is my point. It still could happen but I won’t hold high hopes on the mess being sorted in the courts in time. We can live and hope though. Plan B to me looks more promising, namely the reset button – PROVIDED Trump has the evidence needed to justify his action to call in the military given it’s an extremely serious step to take. Obviously such action should not be taken lightly under any circumstances. If not done with the right intentions and support, it could cause more harm than good to Trump and his supporters. I have enough confidence he will do the right thing no matter what.

The real Holy Grail is to get rid of the Electoral College which is the only thing that stands between them and perpetual control of the Executive Branch. Trump lost the popular vote by millions both in 2016 and this year too. Not that it mattered, since the popular vote doesn’t count, but that could be changed. (Note that the votes stole only amounted to probably less than 100,000 strategically placed to win the EC count. Trump is honestly millions of votes popularly behind Biden/Harris.)

    If we had a popular vote, then the Democrats will control the Executive Branch forever more due to the population density of big coastal elite cities.

    I realise this is a climate science blog not a realpolitik game theory blog, so ya’ll can be forgiven for missing the subtly of the jam we’re in. If Trump pulls out some half-assed Executive Order to challenge the Electoral College it’s a double losing proposition for us and a win/win for the anti-constitutional order Leftists. Trump would set a precedent for clinging to power by EO and that will be pure irony gold for the next Leftist wannabe Caesar, President-for-life demagogue, who is probably sitting for his social justice exams about now at an Ivy League university dreaming of the day he (or zhe) can have the Washington monument torn down and increase the Supreme Court to 40 members stacked with his comrades.

    History is never a simple linear projection, it’s complex and chaotic. The best outcome now is for Trump to peacefully step down rather than to screw around with setting a horrible new precedent the Left will surely abuse in the near future. Trump must retire for the good of the nation.

    Biden’s election is exposed for what it is. Biden is saddled with an irrational policy platform sure to disappoint a majority of Americans and weaken the country, but ultimately that’s a gift to helping restore Congressional power to the center right in 2022 and with proper election oversight could see a Republican returned to the White House in 2024 rather than Harris.

    The mid to late 20th century golden age of consensus politics when both the center left and right were working for the good of the nation ended several decades ago and we are now skating on thin ice towards a possibly brutal end game scenario dominated by the Marxist game theory of Lenin, Trotsky, Alinsky, Obama and Gramsci. As conservatives we must do everything we can do to conserve – even restore – the constitutional norms rather than play into the left’s game of eroding tradition at every turn of history’s worm, even when this means short term losses because we live by American values. The end never justifies the means. We’ll have to take one for history now and keep the faith. Live and learn. Do not let the Left gaslight us into demolishing constitutional norms.

    Just because the Democrats have acted in bad faith doesn’t mean we should rip up the traditional constitutional rule book. Trump pulling an executive order out of his hat to stop the January transition of power would be a worse historical tragedy than a stolen election. This isn’t the first election that was ever stolen in the US, but it would be the first time a President refused to concede defeat by abusing the executive power vested in him to cling to office when clearly the majority of voters do not support him. Remember Trump lost the EC by only tens of thousand of strategically placed – and probably stolen – votes but popularly he doesn’t carry majority support of the nation as a whole. Trump has no mandate from the American people to cling to office despite foul play by Democrats. To do anything other than graciously concede at this point would lead to national, perhaps even global, chaos and this would deeply please the Leftist anarchists who long for just such a foolish chess move by Trump. But it ain’t gonna happen.

    Conservatives do not cause constitutional crises. That’s what fanatical Marxist radicals do. We seek to preserve and protect Constitutional precedent through due process. To a real conservative an election is just an election. There will be others. No election matters more than The Union. Trump is just about out of luck in the courts, so it’s time to concede and then rally around properly organizing to resolve the law and oversight around election processes state by state. It will be a grueling and boring operation I’m sure you’ll lose interest in.       Wasn’t the time bought by the holdouts at The Alamo crucial for Sam Houston to rally/organize the Texan militia in order to defeat the Mexican Army? They may have been trapped but they could easily have surrendered, letting the Mexican army progress unchecked into the heart of Texas.

      The continuing challenge to the 2020 US Election results is necessary to make the wider masses see the extent of the fraud that has been perpetuated, if only through the continued evasive responses of the Democrats, RINOs and media, since the direct evidence has been destroyed in many cases.

      All challenges so far have been in accordance with the US Constitution and will remain so, IMO. Show us an example of violation of the US Constitution by those who have attempted to launch action against the election results.

      Sure, there are hot heads who talk of vigilantism and martial law but they are a minority and unrealistic IMO

        Throughout all of this (starting around 04 November, give-or-take), I am reminded of a small event(s) during the 1960’s and early 70’s; some of us ‘affectionately’ refer to this as the ‘Southeast Asian War Games’.

        One side was fairly consistent in tending to lose every battle.

        Then they won the war.

        Perhaps the parallel does not exist here, but if it should, you read it here first.

        As an ailing retiree, I’m not in a position to buy Jo some chocolate. The only thing that has kept me going since 03 November is this website, and it’s realistic appraisal of the situation, and the posts that have detailed analysis.
